Statutory Termination Benefits
Under the Regulations, employees with 1+ year of service who are retrenched are entitled to termination benefits: less than 2 years of service = 10 days' wages per year, 2-5 years = 15 days' wages per year, 5+ years = 20 days' wages per year. These are minimum entitlements and many employers offer enhanced packages. Days' wages are calculated based on the daily rate of pay (monthly salary / 26).
The LIFO principle requires employers to select employees for retrenchment based on length of service within the same job category. Employers must also report retrenchments to the nearest Department of Labour office at least 30 days before the exercise.
Notice Period and Other Payments
Statutory notice periods are: less than 2 years of service = 4 weeks, 2-5 years = 6 weeks, 5+ years = 8 weeks. Payment in lieu of notice is permitted. On termination, employers must pay out accrued annual leave, any pro-rata bonus contractually due, and outstanding wages. EPF (KWSP) contributions must be paid through the last day of employment.
